2. Letter of Exclusivity (LOE) Agreement
By submitting your electricity bill or responding to any communication from Watt Panda, you agree that Watt Panda is authorized to act as your exclusive energy broker for the purpose of obtaining pricing and negotiating energy contracts on your behalf. This exclusivity remains in effect unless explicitly revoked in writing.
3. Services Provided
Watt Panda operates as an electricity brokerage service, assisting users in locating, evaluating, and enrolling in energy services through third-party providers (“Providers”). We do not generate, transmit, or distribute electricity.
4. User Eligibility
You must be at least 18 years old and possess the legal authority to enter into agreements to use our services. By using our services, you represent and warrant that you meet these eligibility requirements.

While we strive to provide accurate and up-to-date information, we do not guarantee the availability, rates, or terms offered by Providers. All energy transactions are conducted directly between you and the Provider. Watt Panda is not a party to any contract between you and any Provider and shall not be liable for any disputes arising from such contracts.

All content, trademarks, service marks, and logos provided by Watt Panda are the property of the Company or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the services for personal, non-commercial use.

We reserve the right to suspend or terminate your access to our services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.
10. Disclaimer of Warranties
Our services are provided “as is” and “as available” without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
11. Limitation of Liability
To the fullest extent permitted by law, Watt Panda shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein.

Watt Panda is an independent electricity brokerage service committed to connecting customers with competitive electricity rates tailored to their needs. While our recommendations are based on current market conditions and individual usage patterns, plan availability and pricing may vary. Watt Panda operates transparently to help you make informed decisions, but the final choice of provider and plan rests with the client. For complete details about any plan, including terms of service and the electricity facts label (EFL), please review all documentation carefully before proceeding.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state in which Watt Panda operates, without regard to its conflict of law principles.
14. Changes to Terms
We may modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website. Your continued use of the services after such changes have been posted constitutes your acceptance of the new Terms.
